Welcome to Asia Diving Vacation. This website is owned and operated by Duis Dive. By visiting this website or submitting an inquiry, you agree to the following terms and conditions. Please read them carefully.

Privacy

Please review our Privacy Notice, which governs your visit to this website and describes how we collect, use, and protect your personal information.

Electronic Communications

When you submit an inquiry or contact us through this website, you consent to receiving communications from us electronically, including via email and WhatsApp. You agree that communications provided electronically satisfy any legal requirement that such communications be in writing.

Booking Process

Submitting an inquiry through this website does not constitute a confirmed booking. Once you submit an inquiry, our team will contact you via email or WhatsApp with a personalised quote.

A booking is only confirmed when:

  1. You have accepted our written quote, and
  2. We have received your deposit or full payment as specified in the quote.

We reserve the right to withdraw or amend any quote prior to confirmation of booking.

Pricing and Currency

Prices displayed on this website may be shown in your local currency for convenience and are indicative only. All formal quotes are issued in the resort's preferred currency, which may be USD, EUR, MYR, IDR, or another currency as applicable.

For payment:

  • Telegraphic transfers (TT) may be made in various currencies as agreed at the time of booking.
  • Local bank transfers and credit card payments are charged in Malaysian Ringgit (MYR) at a mid-market exchange rate applied at the time of payment.

Asia Diving Vacation is not responsible for any losses arising from currency fluctuation between the date of quotation and the date of payment. Any bank charges, transfer fees, or currency conversion costs are the responsibility of the customer.

Payment

We accept the following payment methods:

  • Bank Transfer (local Malaysian banks, charged in MYR)
  • Telegraphic Transfer (TT) (international wire transfer, various currencies)
  • Wise (international transfer)
  • Credit Card (charged in MYR) — we will send you a payment link via email. The link directs you to a secure Maybank payment page where you complete your payment directly. We do not collect, store, or have access to your credit card details at any time.

A booking is not confirmed until payment has been received and acknowledged by us in writing.

Deposits and Balance Payments

A non-refundable deposit is required to confirm your booking. The deposit amount and balance payment deadline will be specified in your quote and may vary by resort. The remaining balance is due by the date stated in your quote. Failure to pay the balance by the due date may result in cancellation of your booking without refund of the deposit.

Cancellations and Refunds

All cancellation requests must be submitted in writing to customercare@asiadivingvacation.com.

Cancellation and refund terms vary by resort. We adhere closely to each resort's own cancellation policy, which will be communicated to you at the time of booking confirmation. Some resorts permit a refund of the deposit under certain conditions; others do not. Please refer to the individual resort page on this website for the applicable cancellation policy before booking.

We strongly recommend purchasing comprehensive travel insurance that includes trip cancellation cover.

Amendments

Requests to amend a confirmed booking (changes to dates, destinations, or the number of participants) must be submitted in writing. We will endeavour to accommodate amendments subject to availability and supplier conditions. Any amendment fees charged by third-party suppliers will be passed on to you.

Travel Insurance

We strongly recommend that all customers purchase comprehensive travel insurance prior to travel. At minimum, your policy should cover:

  • Trip cancellation and curtailment
  • Medical expenses and emergency evacuation
  • Diving-related incidents (ensure your policy explicitly covers recreational scuba diving)
  • Loss of baggage and dive equipment

Asia Diving Vacation accepts no liability for losses that would have been covered by adequate travel insurance.

Medical and Fitness

Scuba diving is a physically demanding activity that requires a minimum standard of health and fitness. By booking a dive trip through us, you confirm that:

  • You are medically fit to scuba dive, or will obtain clearance from a qualified physician prior to travel.
  • You will disclose any relevant pre-existing medical conditions to the dive operator upon arrival.
  • You accept full personal responsibility for your health and safety underwater.

Individual dive operators may require you to complete a medical declaration form on arrival and reserve the right to refuse participation if they consider it unsafe to do so.

Third-Party Suppliers

Asia Diving Vacation acts as an agent on your behalf in arranging travel, accommodation, diving, and related services provided by independent third-party operators, including resorts, liveaboards, dive centres, and transport providers. These suppliers have their own terms and conditions, which will apply to your booking.

Asia Diving Vacation is not liable for the acts, omissions, or negligence of any third-party supplier, nor for any injury, loss, damage, delay, or inconvenience arising from circumstances beyond our control. Our liability to you is limited to the amount paid to us for the services arranged.

Force Majeure

Asia Diving Vacation is not liable for any failure or delay in performing its obligations where such failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, severe weather, war, civil unrest, terrorism, pandemic or epidemic, government travel advisories, strikes, or closure of dive sites by local or national authorities.

In such circumstances, we will endeavour to offer an alternative arrangement or a credit note where possible, subject to supplier conditions.

Content on this website — including text, graphics, and logos — is the property of Duis Dive and is protected by international copyright laws.

Images on this website are sourced from a variety of origins: some are owned by Duis Dive, some are provided by resorts and used with permission, and some are published under Creative Commons licences. The copyright status and licence terms vary by image. If you wish to use any image from this website, please check its copyright status before doing so. Unauthorised use of copyrighted images is prohibited. For enquiries about image rights, contact us at customercare@asiadivingvacation.com.

Trade Marks

Duis Dive's trademarks and trade dress may not be used in connection with any product or service that is not Duis Dive's in any manner likely to cause confusion, or that disparages or discredits Duis Dive.

Site Access

Duis Dive grants you a limited, personal, non-transferable licence to access this website for the purpose of making a travel inquiry. Commercial use, data mining, scraping, or systematic extraction of content from this site is prohibited without prior written consent from Duis Dive.

Disclaimer of Warranties

This site is provided on an “as is” and “as available” basis. Duis Dive makes no representations or warranties of any kind, express or implied, as to the accuracy, completeness, or reliability of the information on this site. To the fullest extent permitted by applicable law, Duis Dive disclaims all warranties, express or implied.

Limitation of Liability

To the fullest extent permitted by law, Duis Dive's total liability to you in respect of any booking shall not exceed the total amount paid by you to Duis Dive for that booking. Duis Dive shall not be liable for any indirect, consequential, or punitive damages arising from your use of this website or from travel arrangements made through us.

Applicable Law

These Terms and Conditions are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sabah, Malaysia.

Disputes

In the event of a dispute, we encourage you to contact us first at customercare@asiadivingvacation.com so that we may attempt to resolve the matter amicably before pursuing formal legal proceedings.

Modifications

Duis Dive reserves the right to modify these Terms and Conditions at any time. Changes take effect from the date they are published on this website. Your continued use of this website constitutes acceptance of the updated terms.
